by introducing security requirements as legal obligations for the key economic actors, notably;<\/p><ul><li>operators providing essential services (OES)<\/li><li>suppliers of some key digital services (Digital Service Providers \u2013 DSPs)<\/li><\/ul><p>Member States should have identified Operators of Essential Services (OES) by November 9th, 2018.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section data-particle_enable=\"false\" class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Applicability is not the same for DSPs and OESs:<\/p><ul><li>DSP \u2013 enforced only in case of reported incidents or reported non-compliance to the competent authority<\/li><li>OES \u2013enforced by regular audits<\/li><\/ul><p>OESs are public or private entities that meet all of the following criteria:<\/p><ul><li>The operator provides a service that is essential to society and the economy.<\/li><li>The service rendered depends on network and information systems.<\/li><li>An incident to the network and information systems of that service would have significant effects on its provision.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1b0acdf5 elementor-widget elementor-widget-heading\" data-id=\"1b0acdf5\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<p class=\"elementor-heading-title elementor-size-default\">Member states<\/p>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-dceeb99 elementor-widget elementor-widget-text-editor\" data-id=\"dceeb99\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\tMember States are required to set their own rules on financial penalties which will be effective, proportionate and dissuasive. Member states mandated to designate:\n<ul>\n \t<li>National strategy on the security of NIS defining the strategic objectives and appropriate policy and regulatory measures for OESs<\/li>\n \t<li>Competent Authorities that shall monitor the application of this Directive at national level<\/li>\n \t<li>Computer Security Incident Response Teams (CSIRTs) which shall comply with the requirements set out NIS Annex I<\/li>\n<\/ul><br>\nCSIRTs network shall be composed of representatives of the Member States&#8217; CSIRTs and CERT-EU. Member states may request assistance of ENISA in developing national strategies.
